The PERM process is a request to the Department of Labor to confirm that a position can be offered to a foreign national, as there are no available American workers for that position in a particular geographic region. This process allows you to eventually obtain an immigrant visa that will allow you and some members of your family to get a green card.

The PERM process consists of various stages, the first of which is to determine what position you could apply for in the company. We have worked with many clients to determine the right position based on their skills and company needs, and will be happy to work with you.

 

Once the position is approved by you and your sponsor, a request is sent to the Department of Labor to determine the prevailing salary for the position. Once the Department of Labor has determined the prevailing salary, your employer must announce their position in the company by traditional means. There is a recruitment period, and if no one is qualified to fill the vacancy, then your sponsor can submit a PERM application to the Ministry of Labor. This process takes time. Usually, the Ministry of Labor waits for the determination of the amount of wages within two months. The recruitment period typically takes at least three months, and it can take the Department of Labor about a year to review and confirm the PERM application. The Labor Department may request additional information, such as confirmation of who applied for the job and why they were not qualified, which will delay the whole process.

Nope. If you are the owner of a company, the Department of Labor will reject your request, considering that you are not giving the public a real chance of being hired by your company. Other family members may own the company, and if you specify this, your PERM application may be approved. However, when the case comes to the immigration service, the immigration officer may find that the public had no real opportunity to get the job offered, and therefore will reject the request. We believe that it is best that you do not have the family part of the company that sponsors you, as the risks associated with this are great. If you have a valid work permit card or are allowed to work for a company on a separate visa, you can work for the company during this process. If you do not have a work permit and the visa sponsor is another company, you will not be allowed to work for that company during this process.

The company will be obliged to pay you a salary in the amount after you receive a green card. However, since one of the requirements for obtaining an immigrant visa is to prove that the company has the ability to pay the prevailing salary, you may want the company to pay that salary as soon as possible. No. The PERM process is submitted to the Department of Labor. Once approved, you apply for an immigrant visa through the immigration service.

 

 

Once approved by the PERM by the Department of Labor, you must file an immigrant petition with the immigration service based on this perm-approved. You have six months to file this petition, and if you don’t file it within six months, you’ll have to start the process over again. You can apply for a green card when you submit an immigrant petition to the immigration service.
